Joseph Wisel (as spelled) of Richland Township Bucks County State of

Pennsylvania Yeoman being weak in body but of sound disposing mind and

memory thanks be given to the Almighty for the same do make and put in

writing this my last Will and Testament in manner following:

 

First I order and direct that all my just debt and funeral expenses be

carefully paid

Item I give and bequeath all my wearing apparel unto my two sons, John and

Michael to be equally divided between them

Item I give and bequeath to my beloved wife Catherine a feather bed

bedstead and sufficient bed clothing for the winter season, case of

drawers, table, the ** with her and four chairs to be at her own

disposal also a milk cow ** sheep.

Item It is my will that there be sufficient bread corn and meat if there is

sufficient on hand left for the use of my family for six months after

my decease.

Item It is my will and I order and Direct my executors herein after named

to sell at pubic or private sale all my land and tenements with the

buildings and apartments to the highest and best bidder and also all

my personal estate which is not herein bequeathed as soon as may be

the most convenient time after my decease hereby authorizing and

empowering my executor herein after named to make and execute a good

and lawful deed or Title to the purchaser of my plantation.

Item It is my will that after all my just debt are paid that all the

remainder of my Estate shall be divided as follows:

Item One third part thereof I give and bequeath unto my beloved wife

Catherine during the time she remains a widow which said one third

shall be put in interest and the interest paid unto her yearly during

the time aforesaid.

Item It is my will and I give and bequeath the remaining two thirds of my

estate unto all my children to be equally divided between them share

and share alike or their heirs.

Item It is my will that after the marriage or decease of my beloved wife

the said one third herein before left for her are shall be equally

divided between all my children and their heirs.

Item Whereas my brother Peter has left me to collect his rent and which

said rent is locked up with his other paper in my ** which I direct

Summary of Mary Weisels probate proceedings from the Bucks County Orphan's Court:

 

Mary Weisel died intestate leaving no spouse. Michael and John Weisel, sons of Mary Weisel's deceased younger brother Joseph, were the adminstrators of Mary's estate. Mary's land and possesions were sold and the proceeds divided amongst her brothers and sister. Mary's surviving brothers and sisters are named and where they lived. For her brother Joseph who was deceased, and had left heirs, Joseph's 7 living children are named.

 

Inventory of Mary Weisels Estate was filed September 22, 1838. Her personal possesions, notes & bonds were appraised at $1830.80.

 

The petition to settle the estate was filed by John and Michael Weisel on October 28, 1838. A transcription of the petition follows at the end of this summary.

 

John and Michael Weisel petitioned to sell Mary Weisel's 64 acres of land on January 23, 1839, for the benefit of all the heirs. The land was sold for $1166.74.

 

The list of creditors and fees paid totaling $752.20 was submitted by John and Michael Weisel on April 27, 1840. $2,251.40 remained to be distributed to the heirs.

 

The final settlement was presented to the Bucks County Orphans Court on Sept 14, 1840.

The Commonwealth of Pennsylvania, -- To the Sheriff of Bucks County -- Greeting:

 

Whereas, at an Orphan's Court, held at Doylestown, in and for the County of Bucks, the 29th day of October

in the year of our Lord, one thousand eight hundred and thirty eight. The Petition of Michael Weisel and

John Weisel two of the children of Joseph Weisel decd, who was a brother of Mary Weisel, Late of the township

of Richland in the county of Bucks, deceased -- was presented and read,

 

Respectfully Shewing, that the said Mary Weisel died intestate, leaving no spouse, but brothers and sisters and their Representatives viz George Weisel a brother in Bedford County, Jacob Weisel a brother in Bedford County, Peter Weisel a brother in Bedford County, John Weisel a brother in Bedford County, Elizabeth a sister married to Benjamin Stein of Philadelphia, and the issue of Joseph Weisel a decd brother viz Michael, John, Livia married to Dr. Chas. Meredith, Joseph, Hannah, Elizabeth, and Henry the last four of whom are in their minority & have guardians, that the said intestate died seized in her demesne as of fee of and in a certain messuage and tract of Sixty four acres and one hundred and thirty one perches of Lands Situated in Richland Township, bounded by lands of Jacob Smith, Abraham Dirstine and others.

Summary of Mary Weisels probate proceedings from the Bucks County Orphan's Court:

 

Mary Weisel died intestate leaving no spouse. Michael and John Weisel, sons of Mary Weisel's deceased younger brother Joseph, were the adminstrators of Mary's estate. Mary's land and possesions were sold and the proceeds divided amongst her brothers and sister. Mary's surviving brothers and sisters are named and where they lived. For her brother Joseph who was deceased, and had left heirs, Joseph's 7 living children are named.

 

Inventory of Mary Weisels Estate was filed September 22, 1838. Her personal possesions, notes & bonds were appraised at $1830.80.

 

The petition to settle the estate was filed by John and Michael Weisel on October 28, 1838. A transcription of the petition follows at the end of this summary.

 

John and Michael Weisel petitioned to sell Mary Weisel's 64 acres of land on January 23, 1839, for the benefit of all the heirs. The land was sold for $1166.74.

 

The list of creditors and fees paid totaling $752.20 was submitted by John and Michael Weisel on April 27, 1840. $2,251.40 remained to be distributed to the heirs.

 

The final settlement was presented to the Bucks County Orphans Court on Sept 14, 1840.

 

Transcription of the "Petition for Inquest on the Estate of Mary Weisel decd [deceased]"

The Commonwealth of Pennsylvania, -- To the Sheriff of Bucks County -- Greeting:

 

Whereas, at an Orphan's Court, held at Doylestown, in and for the County of Bucks, the 29th day of October

in the year of our Lord, one thousand eight hundred and thirty eight. The Petition of Michael Weisel and

John Weisel two of the children of Joseph Weisel decd, who was a brother of Mary Weisel, Late of the township

of Richland in the county of Bucks, deceased -- was presented and read,

 

Respectfully Shewing, that the said Mary Weisel died intestate, leaving no spouse, but brothers and sisters and their Representatives viz George Weisel a brother in Bedford County, Jacob Weisel a brother in Bedford County, Peter Weisel a brother in Bedford County, John Weisel a brother in Bedford County, Elizabeth a sister married to Benjamin Stein of Philadelphia, and the issue of Joseph Weisel a decd brother viz Michael, John, Livia married to Dr. Chas. Meredith, Joseph, Hannah, Elizabeth, and Henry the last four of whom are in their minority & have guardians, that the said intestate died seized in her demesne as of fee of and in a certain messuage and tract of Sixty four acres and one hundred and thirty one perches of Lands Situated in Richland Township, bounded by lands of Jacob Smith, Abraham Dirstine and others.

Joseph Wisel (as spelled) of Richland Township Bucks County State of

Pennsylvania Yeoman being weak in body but of sound disposing mind and

memory thanks be given to the Almighty for the same do make and put in

writing this my last Will and Testament in manner following:

 

First I order and direct that all my just debt and funeral expenses be

carefully paid

Item I give and bequeath all my wearing apparel unto my two sons, John and

Michael to be equally divided between them

Item I give and bequeath to my beloved wife Catherine a feather bed

bedstead and sufficient bed clothing for the winter season, case of

drawers, table, the ** with her and four chairs to be at her own

disposal also a milk cow ** sheep.

Item It is my will that there be sufficient bread corn and meat if there is

sufficient on hand left for the use of my family for six months after

my decease.

Item It is my will and I order and Direct my executors herein after named

to sell at pubic or private sale all my land and tenements with the

buildings and apartments to the highest and best bidder and also all

my personal estate which is not herein bequeathed as soon as may be

the most convenient time after my decease hereby authorizing and

empowering my executor herein after named to make and execute a good

and lawful deed or Title to the purchaser of my plantation.

Item It is my will that after all my just debt are paid that all the

remainder of my Estate shall be divided as follows:

Item One third part thereof I give and bequeath unto my beloved wife

Catherine during the time she remains a widow which said one third

shall be put in interest and the interest paid unto her yearly during

the time aforesaid.

Item It is my will and I give and bequeath the remaining two thirds of my

estate unto all my children to be equally divided between them share

and share alike or their heirs.

Item It is my will that after the marriage or decease of my beloved wife

the said one third herein before left for her are shall be equally

divided between all my children and their heirs.

Item Whereas my brother Peter has left me to collect his rent and which

said rent is locked up with his other paper in my ** which I direct

shall not be taken account of in the inventory at my house but be

given to him when called for

Lastly I nominate constitute and appoint my beloved wife Catherine and

my brother-in-law Henry Heller to be my executors of this my last will

and testament hereby declairing this and the foregoing page to be my

last will and testament in witness whereof I the said Joseph Wisel (as

written) have hereunto set my hand and seal the twenty fourth day of

April in the year of Our Lord One Thousand With Hundred and Twenty

Seven.
