  • Court Agreement between Michael Wisely and his Daniel [Summary of Agreement]

    On December 1, 1838 Michael Wisely arranged an agreement with his son Daniel Wisely and Daniel's heirs. The agreement gave Daniel the lower part of the plantation in exchange that Daniel and his heirs will support Michael Wisely and his wife Margaret during their natural life.

     

    Details were specified on provisions Daniel was required to deliver monthly, quarterly and yearly. Daniel was also required to complete a comfortable house for Michael and Margaret and provide: warm and comfortable apparel; firewood; and a fence around the garden.

     

    On October 20, 1840 Margaret Wisely signed her consent that she fully supported the articles within the "agreement with my son Danl Wiseley".

Note on Husband: Johannes Frederick WEISEL

Evidence that Frederick Weisel is a son of Michael Weisel and Sussana is

based on the following two items:

1) In the will of Michael Weisel, he refers to his eldest son only as

"my eldest son".

2) Frederick Wysell was a passenger on the ship John and William

along with Michael Weissel. Frederick was the only other Weisel

who "took the oath", meaning he was 16 or older, therefore the

oldest son of Michael and Susanna..

3) Frederick Weisel of Bucks County was naturalized in 1762.

 

Additional sources showing the existence of Frederick and that he married

and lived in Bucks County, Pennsylvania:

1) From the Tohickon church records, page 200:

child of Frederick Weisel died January 26, 1758, buried January 27.

2) In the 1769 will of Sibilla Kaehler, her daughter Elisabeth is married to Frederick Weisel. He is named as a son-in-law. There is no other Frederick of an age to match as the husband of Elisabeth Kaehler/Koehler.

 

The evidence is the Weisel family was not referring to Frederick by his given name, only by "eldest Son". In George Michael's 1757 will he refers to his "eldest Son" and in the 1770 probate records for the deceased Michael, he is again referred to as the "Eldest Son"

Michael Wisely, who served in the War of 1812, placed as the son of Johannes b. 1760, could also be the son of Michael b. ~1775 or John David b. ~1773.

Peter X. WISELY Sr. was born in 1773 in North Carolina.

In 1832 he owned property in the Reed Creek Area, Wythe County, Virginia. His property was south of Sebastian Arney's, across from the Zion Church. He signed a will on 18 MAY 1850 in Wythe County, Virginia. His estate was probated on 12 FEB 1855 in Wythe County, Virginia. He was married to Magdalena "Polly" PHILIIPPI (daughter of Johannes (John) PHILLIPI / PHILLIPPY and Maria Eva Barbara AICHELBERGER / EICHELBERGER). They had following 11 children:

 

Peter WISELY Jr. (1799-1867) married Maria ARNEY (daughter of Sebastian ARNEY and Anna Maria (Mary) PHILLIPPI). They had the following children: John WISELEY, Ann (Annie) WISELEY, Freeland WISELEY, & Polly C. WISELEY.

Last Will of Sibilla Keahler

In the Name of God Amen this thirteenth day of October in the Year of our Lord one thousand and seven hundred & sixty nine I Sibbilla Keahler as relict & widow of Michael Keahler, late of Upper Milford Township in the County of Northampton deceased being for sometime Indisposed as to my health but not so ill as to be confined to my bed yet. I thanks my God that I am at present of sound & perfect memory & understanding. And knowing that it is appointed for all men once to die I do make this my Last Will & Testament Renouncing all others formerly made or done by me heretofore. And that in manner as follows that is to say first my Will is that all my just debts & funderal charges be paid & satisfied by my Executor herein after named and appointed.

Item - it is my Will and I do order that all my clothes bedding chests colosot all the residue of my Moveable & personal Estate and all every other sorts of my Household Good & Tools whatsoever shall be sold by wayof a publick Vendue by my herein named Executor.

Item - it is my Will that my Children Viz Catharina, Elisabeth, Sibilla & my son Jacob shall divide my money Share & Share alike and the money that then shall fall or come due out of my Estate unto my Daughter Elisabeth shall be paid unto her when her Husband Frederick Weisel is dead or his decease & if it shall happen my Daugher Elisabeth shall die before her Husband Frederich Weisel then her Children shall have & receive the whole one share by my Executor according as they come to age.

Item - I give & bequeath unto my beloved son Jacob Keahlor Twenty Pounds Pennsylvania Currency per advance or over & above his equal share and the same also be paid in six months next after my decease.

Item - I give unto my son in law Frederick Weisel one English Shilling of Sterling to be paid unto him within three months next after my decease & this shall be his full share & portion out of my Estate. And further I nominate & appoint my beloved Son Jacob Keahler to be my only Executor of this my Last Will & Testament as Witness my hand & Seal the day & year first above written.

In the name of God,Amen. I, Daniel Wiseley of the County of Wythe and Commonwealth of Virginia, being of sound mind and memory,think proper to make this my last will and testament in manner and form following:

I desire that all my just debts be paid promptly. I give and devise to my daughter Savilla Phelps and heirs 50 acres of land to be taken from the lower end of my plantation on Reed Creek to include a spring, to be laid off by two or more persons to be selected by the County Court of Wythe and appointed commissioners for that purpose. I do give to my said daughter Savilla Phelps two hundred dollars in money. My daughter Polly Wiseley having lately departed this life, it is my will and I hereby direct that the share or portion of my estate which would have gone to my said daughter Polly,if living,upon an equal division and distribution of my estate between all my children and representatives, be divided equally between my four surviving daughters:to wit, Barbara Straw, Polly Gray, Savilla Phelps and Susan Cassell, and I will and direct the sum of 500 dollars which I had intended to give to my saiud daughter Polly in addition to an equal share withmy other children be also divided equally between my said surviving daughters.

It is my will and i hereby direct that all the remainder of my estate both real and personal not hereinbefore devised be divided equally among all my children, subject to the dower interest of my beloved wife Elizabeth,should she survive me,to my two grandchildren Akin and Susan Lambert,children of my second daughter Elizabeth,to take together and share to them and their heirs forever.

In the name of God, amen, I Peter Wisely of the County of Wythe & State of Virginia Being weak in body But of sound mind & disposing memory for which I thank god and calling to mind the uncertainty of Human life & ...to dispose of all such worldly estate as it has pleased God to bless me with. I do hereby make this my last will & testament in manner & form following, that is to say I desire all the Perishable Property belonging to my Estate be sold immediately after my desease & all my Just debts to be paid & Funeral expenses that the Ballance of the proceeds then be Equally Divided between my heirs after named Children and Grand Children, viz.: Fredrick Wisely. (the Four Children of Henry Huffman namely Draper, Jane, Washington, & Eaphaim), Joseph Vaught, Ephraim Greaver, Rosina Deavor, Michael Wisely, Peter Wisely, Heirs, And Polly Hurt. I give & bequeath unto Henry Huffman six? dollars and to be paid by him after named (?) Extor I give & bequeath unto the four Children of Elizabeth Huffman sixty Dollars to be put on interest until they become of age. My Executor to settle with them By my account book against Them so as to make them all equal in my Personal Property & the proceeds of my Estate. I give & bequeath unto my daughter Polly Hurts two children, namely George Washington & Andrew Jackson Hurt - Two Hundred Acres to be surveyed unto them of the west end of my land, its whole to be subject unto the management & Controll of 9(a) Mary their Mother during her life time after her desease to then this said George and Jackson. Forever. I give & Bequeath unto Michael Wisely the balance of my land Adjoining his Plantation at Three dollars per acre to be Equally Divided and paid five years after my desease & should my Beloved wife 10 Molly out Live me my son Michael Wisely is to provide for all her necessities for which he is to be repaid for all his troubles out of my estate.

 

Lastly I do hereby appoint & Constitute Michael Wisely Executor & Administrator of this my last will & Testament. Revoking all wills heretofore made in Witness Whereof I have hereunto set my hand and afixed my seal this 18th day of May in the year of our Lord - 1850.

Wythe County that on this 27 day of August AD 1852 personally appeared before the subscriber & Justice of the Peace in and for the county and state appeared Peter Wisely aged Seventy Eight years and who having first been duly sworn according to law says as followes to wit - This offi? state and way what that he formed his first acquaince with James Sage decd when just small and been near him for several years - in a about my first acquaintance with same Sage he was in the service of the revolutionary war recording to the best of my recollection he remained in said war at different times say two years from my own personal knowledge of his services - on or about the same time my brother Daniel Wisely was ? in said war and served his time out in said war and at that time my Brother and said James Sage decd was not living for a part - it was will understood in the neighborhood that siad Sage was a b? soldier in said war - affiant has no recollection of the ? between James Sage and his wife Lovice affiant do? recollect that at the time he was married and Sage & his wife Lovice was living to gether as husband and wife and his several children affiant was Married in year 1792 they raised a very large family of children and during that length of time & never have their marriage doubl? and that I believe that they were lawfully married or should of had it spaking of in my acquaintance a sworn and subscribed to on the day and date found above.
